Sam Alito has questioned this power and now Thomas and Gorsuch are challenging its constitutionality and general legality. To be clear the UN has called doctrines, policies and practices like this, racist, scientifically false, legally invalid, morally condemnable and socially unjust. So where are Kagan, Jackson and Sotomayor?
