People v. Beverly, 2025 CO 18 (May 5, 2025) If a person commits suicide by ingesting fentanyl, the suicide can be an intervening cause that renders the distribution of fentanyl not the proximate cause of death for purposes of section 18-18-405(2)(a)(III)(A).

U.S. v. Santiago, No. 24-6015 (April 30, 2025) No objectively reasonable officer could rely on a search warrant that clearly fails to comply with the Fourth Amendment’s particularity requirement. Therefore, the Tenth Circuit reversed the trial court’s decision to not suppress evidence based on the good faith exception.

U. S. v. Ward, No. 23-7088 (May 6, 2025) At trial, a prosecutor commits plain error by commenting on a defendant’s post-Miranda partial silence in a way that indicates the defendant is guilty. On appeal, the government waives review of a plain error prong by failing to contest that prong.
