On this episode, Scott Johnson and Peter Mingils start the radio show by discussing a recent ban of Hemp and CBD in the recent CR Bill.

Background on Hemp and CBD LegalizationHemp and CBD products exploded in popularity after the 2018 Farm Bill legalized the cultivation and sale of hemp-derived products, defined as those containing no more than 0.3% delta-9 THC (the primary psychoactive compound in cannabis) by dry weight. This created a "loophole" allowing manufacturers to chemically convert CBD (a non-intoxicating cannabinoid) into semi-synthetic intoxicating alternatives like delta-8 THC, THCA, HHC, and others. These products—often sold as gummies, vapes, seltzers, and tinctures in gas stations, online, and smoke shops—bypassed federal marijuana restrictions but raised safety concerns due to inconsistent testing, high potency, and lack of age or dosage regulations. The industry grew to a $28 billion market, supporting over 300,000 jobs, but drew criticism from states, the marijuana industry, and public health advocates for undermining regulated cannabis markets and posing risks to youth.The November 2025 Continuing Resolution (CR) BillIn early October 2025, a federal government shutdown began—the longest in U.S. history—after Congress failed to pass a full-year spending package. To resolve it, lawmakers negotiated a "minibus" Continuing Appropriations Act, 2026, which funds federal agencies through January 30, 2026, while including full-year appropriations for sectors like agriculture, the FDA, veterans' affairs, and military construction.Buried in this omnibus bill (specifically Section 781 of the Agriculture-FDA portion) is a provision redefining "hemp" under federal law. It amends the 2018 Farm Bill to:

  • Ban the sale of intoxicating hemp-derived products (e.g., delta-8 THC, THCA, HHC) by prohibiting their unregulated distribution in retail settings like gas stations, corner stores, and online platforms.
  • Impose a strict limit of 0.4 milligrams of total THC per container (including all THC forms, not just delta-9).
  • Prohibit synthetic cannabinoid production, closing the CBD-to-THC conversion loophole.
  • Require the FDA and HHS to further regulate cannabinoids with "similar effects" to THC.

The bill passed the Senate on November 10-11, 2025 (60-40 vote), the House on November 12 (222-209), and was signed into law by President Trump on November 12. It ends the shutdown immediately but includes a one-year grace period, with the hemp restrictions taking full effect on November 12, 2026. Industrial hemp (for fiber, textiles, or seeds) and pure, non-intoxicating CBD remain legal, but the threshold is so low it could criminalize many full-spectrum CBD products containing trace THC. Why It Was "Buried" and How It Happened" The provision was added later.

The Amway tools scam is a hidden profit scheme within the Amway multi-level marketing (MLM) structure that exploits distributors, often leaving them with financial losses instead of the promised wealth. Amway, a well-known MLM company, markets health, beauty, and home products through independent business owners (IBOs). While the company emphasizes product sales, the real money for top-tier distributors, often at the Diamond level or above, comes from selling motivational "tools” like books, tapes, seminars, and rallies, not from product sales. These tools, promoted as essential for success, create a separate revenue stream that disproportionately benefits upline leaders while draining the profits of lower-level distributors.Distributors are pressured to purchase these overpriced tools, often costing hundreds or thousands annually, with promises of learning the secrets to building a lucrative Amway business. However, studies and lawsuits reveal that 99% of Amway distributors lose money, with average earnings below $100 monthly after expenses. The tools business, controlled by high-ranking distributors like Dexter Yager, generates millions for the elite, who earn significant markups on items like cassette tapes sold at rallies for up to $10,000 a night in cash. Meanwhile, new recruits face high startup costs—starter kits, training sessions, and product samples—further eroding their profits. This creates a pyramid-like structure where uplines profit from downlines' purchases, not retail sales, resembling an illegal scheme.
